Charmed-Cents Terms Of Service revised: January 11, 2006

By signing up and actively using the Charmed-Cents program you agree to all terms and conditions set forth in this agreement. Charmed-Cents may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with Charmed-Cents. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the Charmed-Cents program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

Responsibility of Members:

You must be 18 years of age or older to participate in this program. Our program is open to both US and International* members and is void where prohibited by local governing laws.

*Added 7/28/05: Charmed-Cents is not longer accepting members from India. People signing up from India on or after 7/28/05 will be deleted immediately.

You agree to and must use your own name and email address in the sign-up process and may not assume a false identity.

We check ALL accounts at one point or another. If you claim to live somewhere other than your country of residence, your account WILL be deleted, forfeiting all pay, upgrades and referrals. ANY nonsense information such as hjdpq, or the selection of "I Cheat", will be interpreted as attempted fraud and will also result in the termination of your account, earnings, upgrades and referrals.

You MUST NOT use open or annonymous proxy for the express purpose of falsifying your information or defrauding this program in ANY way. This will result in the immediate deletion of your account and forfeiture of ALL earnings at charmed-cents.com .

The clicking of 3 or more cheat links will result in the termination of your account and forfeiture of any and all earnings, upgrades and referrals. Any use of automatic software for clicking is STRICTLY prohibited and will result in the termination of your account, earnings, upgrades and referrals without notice or second chances.

You may not sign-up multiple times with different email addresses. Your computer must not be shared with another individual that has an existing charmed-cents.com account. If 2 or more accounts are flagged as logging in on the same computer, all accounts will be deleted immediately and all earnings, referrals and upgrades will be forfeited. You MUST have your own payment account. Members with the same payment accounts will be deleted immediately.

You will use your email address / password combination to access your account. It is YOUR responsibility to keep this information confidential. You may change this information by accessing the User Info link. You are solely responsible for any and all use of your charmed-cents.com account including authorization by you to any third party individual who may use your account.

Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by Charmed-Cents be detected it may result in member termination and possible legal action. Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account will be grounds for immediate termination.

You must maintain your email account that you used when signing up Charmed-Cents. You must maintain your e-mail account that you used when signing up with Charmed-Cents. You agree to receive e-mail advertising from Charmed-Cents. limited to no more than (100) per day.

In the event your e-mail account on file becomes closed or blocked to messages from Charmed-Cents, your account will be terminated. This especially applies to e-mail accounts returned for being Full. Any account bouncing more than 3 times with be deleted. If for some reason, you are unable to check your email, please use the vacation setting in your user information section, for up to a maximum of two months. Any member sending us gibberish will result in automatic termination of account and forfeiture of All earnings to date of termination. Auto-responses will also be deleted immediately.

Our advertisers pay for ads based on the total membership that will be reading that ad. As a member, it is your responsiblity to pay attention to what is written and to be able to understand the English language, which is what 99% of our advertisers advertise in. Members with the "I Cheat", "Please Delete Me" or "I Can Not Read English" interests marked on their userinfo page will automatically be deleted and forfeit all earnings because one can assume that a member with any of those marked either did not read what was written or they can not understand English enough to know what it said.

*Effective February 1st, 2006..
We regularly deleted accounts that are 14 days or more inactive and inactive members will lose all earnings, upgrades and referrals.

Added May 16, 2005...Clicking 10 or more wrong turing numbers in a 1 month period will result in the termination of your account and forfeiture of any and all earnings, upgrades and referrals.

Relationship of the Parties:

You and Charmed-Cents are independent contractors, and nothing in this agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and Charmed-Cents. You understand that you do not have authority to make or accept any offers or make any representations on behalf of Charmed-Cents. This includes any selling or transferring of downlines. This is strictly prohibited. If you choose to leave Charmed-Cents, your downline is our property. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program. In addition, anyone found to be breaking terms, such as searching when from unacceptable countries, will forfeit all earnings and their account.

Limitation of Liability:

Charmed-Cents will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or Charmed-Cents program, even if Charmed-Cents has been advised of the possibility of such damages. Furthermore, Charmed-Cents aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.

Payments:

Members may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by Charmed-Cents. Members may earn by referring new members to the Charmed-Cents program. Members must be 10% as active as their referrals to earn from them. Members will be paid via PayPal/Amazon Gift Certificate (US and Canada Only)/MoneyOrder (There will be a fee for obtaining and mailing the money order). Members are allowed one cashout every 30 days. Payments will be made in 90 days or a reasonable time after.

Points:

Points may occasionally be convertible to cash. There is no set rate at which they will be converted. Members can redeem their points in the redemption area of the site, with no limit.


Spam:

You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with Charmed-Cents and may result in legal prosecution. Charmed-Cents strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. Charmed-Cents may charge up to $50 per spam email sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. Charmed-Cents will file charges for recovery of any earnings received from multiple sign-ups.
